General Terms and Conditions of Sale (GTC)

1. Purpose

These general terms and conditions of sale define the rights and obligations of the parties in the context of the remote booking of services offered by the establishment or agency (accommodation, excursions, tourist transport or other tourist services).

They govern all the steps necessary for booking and monitoring the booking between the contracting parties.

The customer acknowledges having read and accepted these general terms and conditions of sale as well as the terms and conditions of sale of the reserved rate, accessible on the booking platform.

These conditions apply to all bookings made online, by telephone, by email or via a booking platform.


2. Reservation

The customer chooses the services presented on the booking platform or offered by the establishment.

He acknowledges having read:

  • the nature of the services,
  • of their destination
  • booking conditions,
  • and the information necessary to complete the reservation.

The client is solely responsible for choosing the services and ensuring they meet their needs. The establishment cannot be held liable in this regard.

The reservation is considered firm and final after validation by the client and receipt of the reservation confirmation.


3. Booking Process

Reservations can be made:

  • via the online booking form
  • by email
  • by telephone
  • or through a partner platform.

The customer must provide accurate and complete information.

The booking process includes, in particular:

  • the selection of services
  • the entry of personal information
  • validation of the general terms and conditions of sale
  • booking confirmation
  • possibly a guarantee by credit card or payment of a deposit.

4. Booking Confirmation

A booking confirmation is sent to the customer by email.

It summarizes, in particular:

  • reserved services
  • the dates
  • the costs
  • the tariff conditions
  • the establishment's contact details
  • the terms and conditions for modification or cancellation.

5. Modification or cancellation by the customer

Cancellation and modification conditions depend on the rate booked.

Unless otherwise stated:

  • The deposits paid are non-refundable.
  • Any late cancellation may incur charges.

In the event of a no-show by the customer , the establishment may charge the amount stipulated in the conditions of the reserved rate.

All reservations are personal and cannot be transferred to a third party without the establishment's agreement.


6. Consumption of services

In accordance with Moroccan regulations, customers may be required to present a valid identity document upon arrival and to complete a police registration form , in accordance with the obligations imposed on tourist establishments.

Any behavior contrary to public order, morality or internal regulations may result in the exclusion of the customer without refund.

The client agrees to abide by the establishment's rules during their stay.


7. Responsibility

The establishment cannot be held responsible for the non-performance or improper performance of the contract in the event of:

  • force majeure
  • made by a third party
  • customer's fault
  • technical problem beyond his control (internet, platform, etc.).

Any fraudulent booking or payment may result in the immediate cancellation of the booking.


8. Complaints

Any complaint relating to the performance of services must be addressed in writing to the establishment within a maximum period of 15 days after the end of the service .

After this period, no claims will be accepted.


9. Price

Prices are shown in Moroccan dirhams (MAD) or in the currency indicated on the platform.

They generally include applicable taxes, unless otherwise stated.

Some taxes may be payable directly on site, including:

  • the tourist stay tax , in accordance with Moroccan regulations.

Any changes to legal or regulatory taxes may be passed on to prices.


10. Payment

Payment can be made:

  • by bank card
  • by bank transfer
  • in cash
  • or by any other means accepted by the establishment.

A deposit may be required to confirm the reservation.

If the reservation is guaranteed by credit card, the establishment may charge a fee in the event of:

  • late cancellation
  • Client's failure to appear.

Online payments can be secured by recognized payment providers.


11. Protection of personal data

The personal information collected is used solely for booking management and customer relations.

In accordance with theLaw No. 09-08 relating to the protection of personal data, the customer has a right:

  • access
  • rectification
  • and the deletion of their personal data.

12. Electronic evidence

Confirmation of the reservation and acceptance of the general terms and conditions of sale constitute an electronic signature having the same legal value as a handwritten signature.

The computer records of the booking platform serve as proof of the transactions carried out.


13. Force majeure

Force majeure refers to any unforeseeable, irresistible and external event preventing the performance of the contract.

In this case, neither party can be held responsible for the total or partial non-performance of the contract.


14. Applicable Law and Disputes

These general terms and conditions of sale are governed by Moroccan law .

Any dispute relating to their interpretation or execution shall be submitted to the competent courts of the Kingdom of Moroccounless otherwise agreed beforehand between the parties.


15. Acceptance of conditions

Booking implies full and complete acceptance of these general terms and conditions of sale.

The establishment reserves the right to modify these conditions at any time. The applicable version is the one in effect at the time of booking.
